Terms

Template – have this reviewed by a lawyer before launch.

Courtesy translation. Only the German version is legally binding.

1. Scope

These terms apply to all contracts between Miss Diffy (owner Maik Rinker, Leonhardistraße 6, 84089 Aiglsbach, Germany) and you as a customer. Our offer is aimed exclusively at consumers.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their self-employed profession.

2. Formation of contract

This website has no shopping cart. Your enquiry through the form, by e-mail, phone or messenger is non-binding.

In response to your enquiry, we send you an individual offer by e-mail. The contract is concluded when you accept the offer within the period stated in it, for example by replying by e-mail.

If we send you a payment link for a single piece, that link is our binding offer. The contract is concluded when you pay through the link.

Language and contract text: the contract language is German. We store the contract text. You receive the offer and our confirmation by e-mail.

3. Prices

All prices are final prices. As a small business under § 19 UStG, we do not charge VAT and therefore do not show it. We state shipping costs in the offer.

4. Delivery and pickup

We deliver within Germany and to EU countries. Goods are shipped to the address you give us. Details, delivery times and costs are under “Shipping & returns”.

You can also pick up your piece at the atelier in Aiglsbach by appointment.

5. Payment

You pay by bank transfer or through a payment link that we send you. The bank details are in the offer or the invoice.

For made-to-measure pieces, a deposit may be agreed in the offer. We start production once you have accepted the offer and, if agreed, paid the deposit.

6. Retention of title

The product remains our property until it has been paid in full.

7. Made-to-measure pieces

We work as a slow-fashion atelier without a stock. We make your pieces to order and to your specifications.

No right of withdrawal: garments made to your specifications are custom-made. Under § 312g(2) no. 1 BGB (German Civil Code) there is therefore no right of withdrawal. For pieces that are not made to your specifications, the statutory right of withdrawal applies. We will inform you about it in the offer.

Cancellation: you can only cancel as long as we have not started production. Please get in touch within 24 hours of accepting the offer if possible.

Defects: if your piece is defective, for example through material faults or workmanship damage, please contact us within 7 days of receipt. Send us photos and a short description. After checking, we offer repair, replacement or a refund. Your statutory warranty rights are not affected.

Measurements: you are responsible for providing correct measurements. Incorrect measurements are not grounds for a complaint. On request, we will explain how to take your measurements or advise you in person before you order.

No returns: we do not take back made-to-measure pieces because you dislike them or the size does not fit.

8. Transport damage

If a delivery arrives with visible transport damage, please report it to the carrier right away if possible and contact us without delay. Photos help. If you miss this, you do not lose any statutory rights, in particular your warranty rights. But you help us to enforce our own claims against the carrier or the transport insurer.

9. Warranty

The statutory warranty for defects applies.

10. Liability

We are liable without limitation for injury to life, body or health, for intentional or grossly negligent breach of duty, under guarantees where agreed, and where the Product Liability Act applies.

In case of slightly negligent breach of essential contractual obligations (cardinal obligations), liability is limited to the foreseeable damage typical for this kind of contract. Cardinal obligations are those whose fulfilment makes the contract possible in the first place and on which you can regularly rely.

Otherwise, liability for damages is excluded.

11. Dispute resolution

We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
